Terms of Service

1. About Motobud

These Terms of Service ("Terms") govern your access to and use of the Motobud platform ("Service"), operated by Motobud ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old to use Motobud. By using the Service you represent that you meet this age requirement. If you are under 18, you confirm that you have the consent of a parent or legal guardian.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws and regulations.
  • Post content that is abusive, defamatory, discriminatory, harassing, or otherwise harmful.
  • Impersonate another person or organisation, or misrepresent your affiliation with any entity.
  • Distribute spam, unsolicited messages, or malicious code.
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure.
  • Scrape, crawl, or otherwise extract data from the platform without our prior written consent.
  • Interfere with or disrupt the integrity or performance of the Service.

5. User-generated content

You retain ownership of content you post on Motobud (profiles, event listings, photos, etc.). By posting content, you grant us a worldwide, non-exclusive, royalty-free licence to use, store, display, and distribute that content solely for the purpose of operating and promoting the Service.

You are solely responsible for your content and warrant that it does not infringe the intellectual property rights or privacy rights of any third party. We may remove content that violates these Terms without notice.

6. Events and third-party content

Motobud is a platform that connects riders and event organisers. We are not the organiser of events listed on the platform and are not responsible for the accuracy, safety, or legality of any third-party event. Participation in any event is at your own risk. Always verify event details directly with the organiser.

7. Intellectual property

The Motobud name, logo, design, software, and all platform content created by us are our exclusive property or licensed to us. Nothing in these Terms grants you any right to use our intellectual property without our prior written consent.

8. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of liability

To the maximum extent permitted by applicable law, Motobud shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service — including loss of data, loss of profit, or personal injury — even if we have been advised of the possibility of such damages.

Where liability cannot be fully excluded by law (including under Belgian consumer protection law), our total liability to you shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) €50.

10. Termination

You may delete your account at any time via the account settings. We may suspend or terminate your access immediately if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately. Sections 5, 7, 8, 9, and 11 survive termination.

11. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of Belgium, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Brussels, Belgium, except where mandatory consumer protection laws in your country of residence require otherwise.

EU residents may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by a prominent notice on the platform at least 30 days before the changes take effect. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
